WUSTEC Privacy Policy
This Privacy Policy informs you about how we, WUSTEC GmbH & Co. KG (hereinafter referred to as “WUSTEC,” “we,”or “us”), collect and otherwise process your personal data (hereinafter also referred to as “data” or “personal data”) in connection with the processing activities described below. This Privacy Policy applies to all our websites or apps (hereinafter referred to as the “Komax Website”) that are under Komax’s control and refer to this Privacy Policy.
If you disclose personal data concerning other individuals (e.g., employee data) to us, we assume that you are authorized to do so and that the data is correct. By submitting such data about other individuals, you acknowledge the above. Please make sure that the other individuals are aware of this Privacy Policy.
We are obligated to handle your data responsibly. This Privacy Policy is designed to meet the requirements of Swiss data protection law and the EU’s General Data Protection Regulation (GDPR). However, whether and to what extent these laws are applicable depends on the individual case.

1. Description and scope of data processing
1.1 Visiting the WUSTEC Website, creation of log files
The web server automatically collects data and information about the computer system accessing our website each time you visit the WUSTEC website. This includes, in particular, information about the browser type and version used, the user’s operating system, the user’s Internet service provider, the referrer URL (websites from which the user’s system accesses the WUSTEC website), websites accessed by the user’s system via the WUSTEC website, as well as the user’s IP address, access date and time, and the client’s file request (file name and URL). This data is saved in our system's log files (or those of third parties) together with other data and collected only for the purpose of statistical analysis.
In addition, WUSTEC also generates client-side error logs. The collection of this data can be prevented in your browser’s cookie settings.
Some pages on the WUSTEC website can only be viewed by visitors that have first created a user account. The respective Terms and Conditions of Use also apply in this case.
If you use other electronic services, such as our Wi-Fi network, we collect certain technical data. This technical data also includes the logs in which we record the use of our systems (log data). In some cases, we can also assign your device (tablet, PC, smartphone, etc.) a unique identification number (an ID). We use this data to ensure a reliable connection, convenient use of the WUSTEC website and other electronic services, the evaluation of system security and stability, as well as for other administrative purposes. The WUSTEC website offers you the opportunity to contact us via the email address(es) posted on the website. In this case, we store the data transmitted with the email. Email traffic is unencrypted. You use these services at your own risk.
1.3. Contact Forms
On our WUSTEC website, we offer you the opportunity to contact us and our experts. This will allow us to contact you and handle your request. The data you enter into this form will be transmitted to us and saved. Depending on the nature of your message, the answers will be generated by (foreign) companies of the WUSTEC Group. By submitting the contact form, you agree that we may process your data and transfer it to companies abroad (including outside Switzerland) (worldwide including the USA and China). You also confirm that you have read and understood our Privacy Policy.
1.4. Mailing List/Newsletter
The WUSTEC website also provides the option of subscribing to a mailing list for media releases in electronic form, as well as other newsletters (industry news, product news, events, etc.). During the registration process, the data you enter in the form will be transmitted to us. Some information is sent by (foreign) companies of the WUSTEC Group or third parties. By registering, you consent to us processing your data, to us transmitting your data to the companies or third parties (including USA) based abroad (also outside Switzerland), to us tracking your click and opening behavior, and to us contacting you directly in individual cases. You also confirm that you have read and understood our Privacy Policy. You can unsubscribe from the mailing list or newsletter at any time.
Insofar as we refer to third-party websites for product information, events, etc. and you visit these websites, the corresponding privacy policies of the respective website operator apply. WUSTEC has no influence on these.
1.5. Job applications
Our job vacancies are published on the WUSTEC website. Our job advertisements and your online application are processed using the “Haufe Talent Management Tool” tool from our software partner Haufe-umantis AG. A separate privacy policy applies to the application process.
1.6. Business Relationships
We process your data that we receive in the context of our business relationship with our customers, other business partners, and other persons involved. This includes, in particular, contact details such as title, first name, last name, gender, date of birth, address, email address, telephone number, and other contact details as well as communication data such as exchanged communication content from emails, other written correspondence, telephone conversations, video conferences, etc. and information on the type, time, and place of communication.

2. Legal Basis of Data Processing
2.1. Within the scope of providing our services and for the fulfillment of contractual obligations
Data is processed for the purpose of providing our services to our customers, including precontractual activities as well as post-contractual support.
The data collected in this way will be used, for example, for the entire performance of our services, including any subsequent warranty claims, technical administration, etc. Further details on data processing purposes can be found in the relevant contractual documents and terms and conditions.
2.2. In the Context of Balancing Interests
To the extent necessary and permissible, we also process your data beyond the scope of actual performance of the contract to protect our legitimate interests or those of third parties. These include:
Consulting and exchanging data with information centers and other third parties (e.g., debt enforcement register);
Reviewing and optimizing needs analysis procedures for direct engagement with customers and collecting personal data from publicly available sources for the purpose of customer acquisition;
Advertising or market and opinion research, insofar as you have not objected to the use of your data;
Asserting legal claims and for the purposes of defense in legal disputes
Safeguarding our IT security and IT operations;
Preventing and investigating crimes;
Measures to manage business operations and make advancements to services and
products and the WUSTEC website;
Acquiring and selling business units, companies, or parts of companies and other transactions under commercial law and the related transfer of data as well as business management activities.
2.3. Based on your consent
If you have granted us your consent to process data for certain purposes, this processing is lawful on the basis of your consent. Consent can be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of the data processed up to the time of withdrawal.
2.4. Due to legal requirements or in the public interest
In addition, we are subject to various legal obligations requiring us to process your data.
3. Cookies/Tracking Tools and Other Technologies
3.1. Use of Analysis Services
We use Google Analytics, a web analytics service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA, USA) and Google Ireland Ltd (Google Building Gordon House, Barrow St, Dublin 4, Ireland) on the WUSTEC website; both referred to collectively as “Google,” with Google Ireland Ltd. being our processor. We use Google Tag Manager, a tag management system that allows WUSTEC to update tracking codes and associated code fragments (“tags”) on the WUSTEC website and apps, to implement Google Analytics. Google Analytics uses cookies (text files) and similar technologies to collect certain information about the behavior of individual users on or in the website in question and the device used for this purpose (tablet, PC, smartphone, etc.) in order to enable analysis of the use of the website.
The information generated by performance cookies (see below) about the use of the website (incl. IP address) is transmitted to the Google server in the USA and stored there. We have configured the service in such a way that the IP addresses of users of the websites are shortened by Google within Europe before being forwarded to the USA, so that they cannot be traced. Google provides us with reports and in this sense can be considered our data processor. Google also processes certain data for its own purposes. Under certain circumstances, Google can use the collected data to draw conclusions about the identity of the visitors to the websites and therefore create personal profiles and link the data obtained with any existing Google accounts of these persons. Google may also pass on this information to third parties if this is required by law or third parties process this data on behalf of Google. If you consent to the use of Google, you explicitly consent to such processing, which also includes the transfer of personal data to the USA and other countries. Salesforce
We also use Salesforce Marketing Cloud Account Engagement Analytics (formerly Pardot), a marketing analytics service provided by our contract processor Salesforce, Inc, Mission St, San Francisco, CA 94105, USA, for marketing automation purposes (email marketing, social media marketing, mobile marketing and online advertising) on the WUSTEC website. In particular, if you subscribe to our newsletter, you explicitly consent to such processing, which also includes the transfer of personal data to the USA and other countries. If you do not want your visit to the WUSTEC website to be evaluated by the analytics services, you can achieve this, for example, by deactivating performance cookies in the cookie settings.
3.2. Cookies
Various cookies are used on the WUSTEC website. Cookies are small text files that are stored in the Internet browser or by the Internet browser on your computer system. Cookies may be necessary for the functioning of the server, to improve performance, and provide additional functions. 3.3. Google Maps
We use the product Google Maps from Google Inc. on the WUSTEC website. By using this website, you consent to the collection, processing, and use of the automatically collected data by Google Inc, its representatives, and third parties. 3.4. Social Media
We use plugins from social networks such as YouTube, Xing, and LinkedIn on the WUSTEC website. The corresponding buttons/symbols can be found on the WUSTEC website. These items are configured to be disabled by default. By clicking on the buttons/icons, the respective operators of the social networks can detect that you are on the WUSTEC website, what your location is, and use this information for their own purposes. The processing of your data is the responsibility of the respective operator in accordance with their privacy policy. WUSTEC does not receive any information from the operators of social networks.
4. Duration of Processing Your Personal Data
We will only process your data for as long as it is necessary for the respective purpose and fulfillment of our contractual and legal obligations, including statutory retention obligations (generally 10 years), or if you have granted us your consent. We will continue to process your data as long as we have a legitimate interest in retaining it. This may be the case, in particular, if we require personal data in order to assert or defend against claims, for archiving purposes, and to ensure IT security.
5. Data Sharing and Transfer Abroad
We will only disclose your data to third parties in the course of our business activities and for the purposes described in this Privacy Policy if we are required to do so by law, court order, or official regulation, if disclosure is necessary for the assertion, exercise, or defense of legal claims or for the performance of contracts and business activities, or based on your consent. These third parties include, in particular:
Data processors such as providers, service providers for the evaluation of the use of the WUSTEC website (marketing purposes), IT service providers (data management, data storage, technical support, etc.), service providers in the field of recruitment, talent management, HR or other services;
External business partners including other companies of the WUSTEC Group and experts in connection with the contractual services and for their own purposes.
We do not only process personal data in Switzerland. Your data can be processed in the European Union as well as in any country in the world (including the USA). If the level of data protection in the country where the third party processing the data is located is deemed inappropriate for Swiss circumstances or within the meaning of the EU’s General Data Protection Regulation (including the USA), we grant suitable data protection by means of appropriate guarantees, unless there is a statutory exception (e.g. your consent), the recipient is not already subject to a legally recognized set of rules to ensure data protection, or we can rely on an exception. Such contractual provisions (guarantees) partially compensate for a weaker or complete lack of legal protection, but not all risks can be completely excluded (e.g., from government access abroad).
Please also note that data exchanged over the Internet is often transferred via third countries. Your data may therefore be transferred abroad even if the sender and recipient are located in the same country.
6. Data Security
We use appropriate technical and organizational measures in the systems to protect your data stored by us from loss, destruction, alteration, and unauthorized access by third parties.
Safety measures of a technical nature include, for example, encryption (including login data) and pseudonymization of data, logging, physical access restrictions, and storage of backup copies.
We also take our own internal company data protection very seriously. Our employees and the service providers we engage are obligated to maintain confidentiality and to comply with the provisions of applicable privacy law. Our data processors are also obligated to take appropriate technical and organizational security measures. Furthermore, they will only be granted access to personal data to the extent necessary.
Our security measures are continuously adapted in line with technological developments. However, absolute protection cannot be guaranteed.
7. Your Rights
You have several options when using the WUSTEC website and our services. You can choose not to provide any data at all by not filling out any related forms or data fields on the WUSTEC website, blocking cookies, and not providing us with personalized data as part of our business relationship.
In addition, if required by applicable law, you have:
The right to information as to whether and what data we process concerning you;
The right to rectification if the data is inaccurate;
The right to request erasure;
The right to request the restriction of data processing;
The right to withdraw your consent;
Where applicable, the right to request that we provide certain data in a commonly used electronic format;

In this context, your rights are not absolute. However, we reserve the right to apply the restrictions provided for by law. We will inform you accordingly.
Each data subject also has the right to enforce their claims in court or to lodge a complaint with the competent data protection authority.
